Welcome to Well Club Apparel. The terms “we,” “us,” and “our” refer to Well Club Apparel, a mission-driven apparel brand designed in Honolulu, Hawaii and operated as part of The Well Club ecosystem.

We operate this website and store, including all related information, content, features, tools, products, and services (collectively, the “Services”), to provide a thoughtful, made-to-order shopping experience. Our store is hosted on Shopify, which provides the technical platform that enables us to offer the Services. All purchases made through this site are made directly with Well Club Apparel.

These Terms of Service (“Terms”), together with any policies referenced herein, govern your access to and use of the Services. By visiting, browsing, or purchasing from our site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

All Well Club Apparel products are designed in Honolulu, Hawaii and produced on a made-to-order basis. This intentional model allows us to reduce waste, avoid overproduction, and operate with a small, lean team.

Because items are produced specifically for each order:

  • Production times may vary

  • Inventory is not pre-stocked

  • Minor variations may occur between items

We make every effort to accurately represent our products through descriptions and visual assets. Some product images may be digitally rendered, enhanced, or generated using design tools to illustrate fit, color, scale, or design placement prior to production. Because all items are made to order, the final product may vary slightly from on-screen representations due to production methods, materials, lighting conditions, or device display settings. We do not guarantee that the final product will exactly match digital images shown online.

SECTION 3 — ORDERS

Placing an order constitutes an offer to purchase. Well Club Apparel reserves the right to accept or decline any order at its sole discretion.

Orders are not considered accepted until payment is successfully processed and order confirmation is issued. Due to our made-to-order production model, orders cannot be canceled, modified, or refunded once accepted, except as expressly stated in our Refund Policy.

You agree to provide valid and authorized payment information and authorize Well Club Apparel to charge your selected payment method for the total amount of your order, including all applicable fees and taxes.

 

 

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather conditions, labor disruptions, supply chain interruptions, governmental actions, or events beyond our reasonable control.

Risk of loss and title for products pass to you upon transfer of the order to the shipping carrier.

 

 

SECTION 6 — INTELLECTUAL PROPERTY

All content available through the Services, including but not limited to logos, designs, text, graphics, images, videos, audio, and overall site design, is owned by or licensed to Well Club Apparel and is protected by applicable intellectual property laws.

You may use the Services solely for personal, non-commercial purposes. No content may be copied, reproduced, distributed, modified, reverse-engineered, or exploited without prior written consent from Well Club Apparel.

 

 

SECTION 7 — OPTIONAL TOOLS

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Well Club Apparel uses Shopify as the e-commerce platform that powers this website. All products, pricing, and transactions are offered by and conducted directly with Well Club Apparel. Shopify does not manufacture, own, inspect, or control the products sold through this site and is not a party to the sales agreement between you and Well Club Apparel.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WELL CLUB APPAREL, THE WELL CLUB, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUPPLIERS, LICENSORS, FULFILLMENT PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Well Club Apparel, The Well Club, and their respective officers, directors, members, affiliates, contractors, licensors, service providers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your misuse of the Services or products
